By accessing or using Zubis (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. We reserve the right to update these terms at any time, and continued use constitutes acceptance of the changes.
Zubis is an online marketplace platform and software service provider. We host independent third-party creators and sellers (“Creators”) who manage their own “Zubi Pages.” Zubis does not own, inspect, validate, or guarantee any products, services, or media listed by Creators. Any transaction, agreement, or interaction occurred through inquiry forms, WhatsApp handoffs, or external links is strictly between the buyer and the Creator. Zubis is not a party to these transactions and holds no liability for order fulfillment, disputes, or financial losses.
You are solely responsible for all content you post, share, or display on your Zubi Page. This includes ensuring your content complies with all applicable South African laws-including the Consumer Protection Act (CPA) and Electronic Communications and Transactions Act (ECTA)-and does not infringe on the rights of others. Creators must display accurate pricing in South African Rand (ZAR) and fulfill customer stock/variant choices honestly. Prohibited activities include listing illegal goods, scamming, or using the block editor for malicious code.
To create a Zubi Page, you must register for an account. You agree to provide accurate and complete information and keep your login credentials secure. You are responsible for all activity under your account. We reserve the right to restrict or modify URL slugs assigned to accounts to prevent trademark infringement or squatting.
You retain ownership of the content you create and upload to Zubis. By publishing content, you grant Zubis a non-exclusive, worldwide, royalty-free license to display, host, and distribute it on the Platform for operational purposes. You may not use Zubis trademarks, logos, or branding layouts without prior written permission.
Certain features (e.g., the Premium tier) are activated through prepaid time-credits that grant access for a set number of days. All payments are processed securely through our integrated third-party payment gateways. Fees are billed in ZAR and are non-refundable unless stated otherwise. We reserve the right to change pricing or feature sets with reasonable advance notice.
Zubis is provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted under South African law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform. This includes, but is not limited to, data loss, transaction disputes, business interruption, or offline safety issues arising from WhatsApp buyer-seller handoffs. In no event shall our liability exceed the amount you paid us in the preceding 12 months.
We reserve the right to suspend, freeze, or permanently terminate your account and remove your Zubi Pages without prior notice if you violate these terms, engage in fraudulent activity, or disrupt the platform infrastructure. You may delete your account at any time via your dashboard.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the South African courts.
